Art Installation Waiver
Assumptions of Risk, Liability Waiver, and Release Form
By participating in this special interactive art installation (“Event”), hosted by Tricon Residential Canada ULC (“Tricon”), and administered by Awe-Nest [1000749112 ONTARIO INC.] and artist Isaac Rayment (“Administrators”), your (“Participant”) respective personal data may be measured and collected by the Administrators. This data includes, but is not limited to, Participant’s brain waves, which will be measured via Participant’s use of the MUSE headband to create unique digital art (the aforementioned “Event”). Tricon will not collect this data, or any other data from Participant other than their full name. Any inadvertent collection of Participant’s data by Tricon will be deleted in accordance with applicable privacy laws. Upon completion of the Event, Tricon will request that the Administrators delete all data they obtained via the MUSE headband at the Event. By completing and submitting this form, Participant acknowledges and agrees that Participant understands the nature of the Event, that there may be inherent risks and dangers associated with the Event, and that Participant knowingly and voluntarily accepts and assumes responsibility for each of these risks and dangers that could arise out of, or occur during, Participant’s participation in the Event. Participant releases, waives, discharges, and covenants to not sue Tricon, the Art Gallery of Ontario (AGO) and their assignees, transferees, principals, partners, officers, directors, employees, subsidiaries, parents, successors, agents, affiliates, creditors, managers, insurers, attorneys and representatives, and each of them (collectively, “Releasees”), from and for any liability or damages whatsoever resulting from any personal injury, accident, illness (including death), physical or emotional distress, personal property loss, or collection and use of personal information, however caused, arising from, or in any way related to, Participant’s participation in the Event.
